Welcome to ViMaxus!
These Terms of Use govern your access to and use of all services provided by ViMaxus, an event marketing agency based in Geneva, Switzerland. By accessing or using our services, you agree to comply with these Terms of Use. If you do not agree, please do not use our services.
1. About ViMaxus
ViMaxus specializes in event staffing and event marketing solutions designed to help brands and event organizers create unforgettable experiences. Our services include, but are not limited to:
- Event staffing (hostesses, brand ambassadors, promoters)
- Event marketing strategy
- Social media campaigns & content creation
- Event automation solutions
- On-site event support
2. Acceptance of Terms
By requesting or using our services, you accept these Terms of Use. These terms prevail over any other conditions unless explicitly agreed in writing.
ViMaxus may update these Terms of Use at any time. The version applicable is the one in force at the time of accepting a service offer.
3. Use of Services
3.1 Orders & Project Confirmation
All services begin only after written confirmation (by email or signature) of our Offer of Services and pricing.
For urgent or ongoing projects, we may start work without formal confirmation if you have been informed and raised no objection within 24 hours.
3.2 Client Responsibilities
To ensure successful project delivery, Clients agree to:
- Provide clear, accurate, and timely information
- Approve deliverables within the agreed timeframe
- Respond to communications promptly
ViMaxus is not responsible for delays or issues caused by incomplete or late client responses.
3.3 Communication
Unless otherwise agreed, communication will take place via email, messaging platforms, or online tools.
Deliverables (visuals, strategies, texts) are deemed approved if no feedback is provided within 3 working days of delivery.
4. Fees & Payment
4.1 Pricing
All prices are provided in the Offer of Services and may include service fees, third-party costs, and administrative expenses.
4.2 Invoicing
Invoices are issued:
- At project completion
- Or periodically for long-term projects
Payment is due within 10 days of invoice date unless otherwise agreed. Late payments may incur a 6% annual interest.
4.3 Advance Payment
ViMaxus reserves the right to request an advance payment (up to 50%) prior to project start.
5. Third-Party Services
ViMaxus may collaborate with external partners (photographers, videographers, influencers, etc.) while remaining responsible for project management.
6. Confidentiality
All information shared with ViMaxus will remain confidential unless disclosure is required by law.
7. Intellectual Property
All materials created by ViMaxus (strategies, visuals, content, presentations) remain the intellectual property of ViMaxus unless otherwise agreed.
Use of these materials is strictly limited to the agreed project scope.
8. Limitation of Liability
ViMaxus provides services with care and professionalism but cannot guarantee specific business outcomes (e.g., increase in sales, followers, or attendance).
Liability is limited to direct damages caused by proven negligence and excludes indirect or consequential losses.
9. Termination
Both ViMaxus and the Client may terminate services at any time with written notice.
In such cases, the Client remains responsible for payment for all work completed up to the termination date.
ViMaxus reserves the right to suspend or terminate services in the event of non-payment.
10. Governing Law
These Terms of Use are governed by Swiss law. Any disputes will fall under the exclusive jurisdiction of the courts of Geneva, Switzerland.
11. Miscellaneous
Any modification to these Terms of Use must be agreed upon in writing.
If any part of these Terms is found invalid or unenforceable, the remaining parts shall remain fully effective.
